Article 2: Purpose
The purpose of these terms and conditions is to define the rights and obligations of the parties in connection with the online sale of goods and services offered by SARL AMHARA to the consumer.
Article 3: Contractual documents
The present contract is made up of the following contractual documents, presented in descending hierarchical order: these general terms and conditions; the order form. In the event of contradiction between the provisions contained in documents of different rank, the provisions of the higher-ranking document shall prevail.
Article 4: Coming into force – Duration
These terms and conditions come into force on the date the order form is signed. The present general conditions are concluded for the duration necessary for the supply of the goods and services subscribed, until the extinction of the guarantees due by the company DE WASSEIGE EQUITATION EURL.
Article 5: Electronic signature
The consumer’s “double click” on the order form constitutes an electronic signature which has the same value between the parties as a handwritten signature.
Article 6: Order confirmation
Contractual information will be confirmed by e-mail at the latest at the time of delivery or, failing that, at the address indicated by the consumer on the order form.
Article 7: Proof of transaction
The computerized registers, kept in the computer systems of SARL AMHARA under reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties. Purchase orders and invoices are archived on a reliable and durable medium that can be produced as proof.
Article 8: Product information
8-a: The company SARL AMHARA presents on its website the products to be sold with the characteristics necessary to comply with Article L 111-1 of the Consumer Code, which provides the opportunity for the potential consumer to know before the final order the essential characteristics of the products he wants to buy.
8-b: SARL AMHARA’s offers are only valid while stocks last.
Article 9: Prices
Prices are indicated in euros and are only valid on the date the order form is sent by the consumer. They do not include delivery charges, which are invoiced in addition and indicated before the order is validated. Prices include the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store. Full payment must be made at the time of ordering. At no time may the sums paid be considered as deposits or advance payments.
Article 10: Method of payment
To pay for his order, the consumer has, at his choice, all the methods of payment mentioned on the order form. The consumer guarantees SARL AMHARA that he/she has the necessary authorizations to use the method of payment chosen by him/her when validating the order form. SARL AMHARA reserves the right to suspend any order and any delivery in the event of refusal to authorize payment by credit card by officially accredited organizations or in the event of non-payment. The company SARL AMHARA reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully settled a previous order or with whom a payment dispute is being administered.
Article 11: Product availability
The order will be executed at the latest within 3 days from the day following the day on which the consumer placed the order. In the event of unavailability of the product ordered, notably due to our suppliers, the consumer will be informed as soon as possible and will have the option of cancelling the order. The consumer will then have the choice of requesting either a refund of the sums paid within 30 days at the latest of their payment, or an exchange of the product. In the event of temporary impossibility (illness, vacation, etc…), the order may be executed within 7 working days from the day following the day on which the consumer placed the order. Article 12: Delivery terms
Products are delivered to the address indicated by the consumer on the order form. It is the consumer’s responsibility to check the condition of the packaging upon delivery and to report any damage to the carrier on the delivery slip, as well as to SARL AMHARA, within one week.

As far as shipping is concerned, we work mainly with Colissimo Suivi. As soon as we proceed with a shipment, you will immediately receive an e-mail informing you.
THE POST OFFICE
To keep shipping costs to a minimum, all small and medium-sized products are shipped by Colissimo Suivi. This service delivers within 48 hours anywhere in France, and gives you the option of picking up your order at a post office close to the delivery address if the letter carrier does not arrive at the initial delivery address.
However, as with any shipment, there may be a delay in delivery or the product may go astray. In the event of a delay in delivery in relation to the date we indicated in the dispatch e-mail, we ask you to notify us of this delay by calling us or sending us an e-mail. We will then contact the Post Office to start an investigation. A Poste survey can last up to 21 days from the survey start date. If the product is found during this period, it will be returned to you immediately. If, on the other hand, the product is not found within the 21-day investigation period, the Post Office will consider the parcel lost. Only then can we send you a replacement product at our expense. If the product(s) ordered are no longer available at that time, we will reimburse you for the amount of the products affected by the carrier’s loss. If the product(s) is (are) still available, but has (have) changed its (their) selling price(s) on the site, we will apply the new selling price(s), either by reimbursing you by cheque for the difference, or by requesting an additional cheque for the price difference. We accept no responsibility for longer delivery times due to the carrier, particularly in the event of loss of products or strikes.
Article 13: Delivery problems caused by the carrier
Any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of “handwritten reserves”, accompanied by the customer’s signature. At the same time, the consumer must confirm this anomaly by sending a registered letter with acknowledgement of receipt to the carrier within two (2) working days of the delivery date, setting out the aforementioned complaints. Article 14: Delivery errors
14-a: The consumer must notify SARL AMHARA on the day of delivery or no later than the first business day following delivery, any claim of error of delivery and / or non-conformity of goods in kind or quality compared to the indications on the order form. Any claim made after this deadline will be rejected.

14-d: In case of error of delivery or exchange, any product to be exchanged or refunded must be returned to SARL AMHARA as a whole and in its original packaging, by Colissimo Recommandé, to the following address:

To be accepted, any return must be reported in advance to Customer Service of the company SARL AMHARA.
Shipping costs are the responsibility of SARL AMHARA, except in the event that the product returned does not correspond to the original declaration made by the consumer in the return form.
Article 15: Right of withdrawal
You have a period of 14 days from receipt of your order to return the product that does not suit you.
Returns must be made in their original packaging, complete (accessories, instructions, etc.), in perfect condition and accompanied by a copy of the invoice.
Items returned incomplete, damaged or soiled by the customer will not be accepted.
Return postage and risks remain the responsibility of the purchaser.
Any returns accepted by our customer service department will result in the creation of a credit note or a refund (at the buyer’s request) to the benefit of the buyer after qualitative verification of the returned products.
Only the price of the returned product(s) will be refunded. You are responsible for shipping and handling costs.
Special case: if the initial amount of your order entitled you to free shipping, two cases may arise:
(1) the value of the returned items will reduce the amount of your order below the carriage paid rate. We will reimburse you for the value of the items returned, after deduction of the shipping costs that were initially offered to you.
(2) the value of the returned items does not reduce the amount of your order below the carriage paid rate. We will reimburse the value of the returned items (excluding promotions and sales).
Article 16: Force majeure
Neither party will have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. An act of God or force majeure shall be deemed to be any facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonable efforts. The party affected by such circumstances will notify the other within ten business days of becoming aware of them. The two parties will then meet within one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the case of force majeure lasts longer than three months, the present terms and conditions may be terminated by the injured party. The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals: blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning; stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.

The prices, descriptions and colors of the products in our Internet catalog are given as an indication only and may be modified according to supplies, economic conditions or the economic situation.
The products offered are in accordance with the French legislation in force. We cannot be held responsible for non-compliance with the legislation of the country where the products are delivered. It is the customer’s responsibility to check with local authorities about the possibility of importing or using the products he/she intends to order.
Article 18: Liability
SARL AMHARA cannot be held responsible for any damage of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products marketed.
Article 19: Applicable law
These terms and conditions are governed by French law. This applies to both substantive and formal rules. In the event of a dispute or claim, the consumer should first contact DE WASSEIGE EQUITATION EURL for an amicable solution. Failing this, all disputes relating to the entire commercial relationship shall fall within the exclusive jurisdiction of the Commercial Court of ANNECY for professionals. Disputes arising from the application of these terms and conditions of sale are subject to French law.
Article 20: Data protection
The information requested from the consumer is necessary for processing the order and may be communicated to contractual partners of the company SARL AMHARA involved in the execution of this order. The consumer may write to the company SARL AMHARA to oppose such communication, or to exercise his rights of access, rectification with regard to information concerning him and appearing in the files of the company SARL AMHARA under the conditions provided by the law of January 6, 1978.
